  9. Statement of Purpose
  10. The laws of most jurisdictions throughout the world automatically confer
  11. exclusive Copyright and Related Rights (defined below) upon the creator
  12. and subsequent owner(s) (each and all, an "owner") of an original work
  13. of authorship and/or a database (each, a "Work").
  14. Certain owners wish to permanently relinquish those rights to a Work for
  15. the purpose of contributing to a commons of creative, cultural and
  16. scientific works ("Commons") that the public can reliably and without
  17. fear of later claims of infringement build upon, modify, incorporate in
  18. other works, reuse and redistribute as freely as possible in any form
  19. whatsoever and for any purposes, including without limitation commercial
  20. purposes. These owners may contribute to the Commons to promote the
  21. ideal of a free culture and the further production of creative, cultural
  22. and scientific works, or to gain reputation or greater distribution for
  23. their Work in part through the use and efforts of others.
  24. For these and/or other purposes and motivations, and without any
  25. expectation of additional consideration or compensation, the person
  26. associating CC0 with a Work (the "Affirmer"), to the extent that he or
  27. she is an owner of Copyright and Related Rights in the Work, voluntarily
  28. elects to apply CC0 to the Work and publicly distribute the Work under
  29. its terms, with knowledge of his or her Copyright and Related Rights in
  30. the Work and the meaning and intended legal effect of CC0 on those
  31. rights.
  32. 1. Copyright and Related Rights. A Work made available under CC0 may be
  33. protected by copyright and related or neighboring rights ("Copyright and
  34. Related Rights"). Copyright and Related Rights include, but are not
  35. limited to, the following:
  36. i. the right to reproduce, adapt, distribute, perform, display,
  37. communicate, and translate a Work;
  38. ii. moral rights retained by the original author(s) and/or performer(s);
  39. iii. publicity and privacy rights pertaining to a person's image or
  40. likeness depicted in a Work;
  41. iv. rights protecting against unfair competition in regards to a Work,
  42. subject to the limitations in paragraph 4(a), below;
  43. v. rights protecting the extraction, dissemination, use and reuse of
  44. data in a Work;
  45. vi. database rights (such as those arising under Directive 96/9/EC of
  46. the European Parliament and of the Council of 11 March 1996 on the legal
  47. protection of databases, and under any national implementation thereof,
  48. including any amended or successor version of such directive); and
  49. vii. other similar, equivalent or corresponding rights throughout the
  50. world based on applicable law or treaty, and any national
  51. implementations thereof.
  52. 2. Waiver. To the greatest extent permitted by, but not in contravention
  53. of, applicable law, Affirmer hereby overtly, fully, permanently,
  54. irrevocably and unconditionally waives, abandons, and surrenders all of
  55. Affirmer's Copyright and Related Rights and associated claims and causes
  56. of action, whether now known or unknown (including existing as well as
  57. future claims and causes of action), in the Work (i) in all territories
  58. worldwide, (ii) for the maximum duration provided by applicable law or
  59. treaty (including future time extensions), (iii) in any current or
  60. future medium and for any number of copies, and (iv) for any purpose
  61. whatsoever, including without limitation commercial, advertising or
  62. promotional purposes (the "Waiver"). Affirmer makes the Waiver for the
  63. benefit of each member of the public at large and to the detriment of
  64. Affirmer's heirs and successors, fully intending that such Waiver shall
  65. not be subject to revocation, rescission, cancellation, termination, or
  66. any other legal or equitable action to disrupt the quiet enjoyment of
  67. the Work by the public as contemplated by Affirmer's express Statement
  68. of Purpose.
  69. 3. Public License Fallback. Should any part of the Waiver for any reason
  70. be judged legally invalid or ineffective under applicable law, then the
  71. Waiver shall be preserved to the maximum extent permitted taking into
  72. account Affirmer's express Statement of Purpose. In addition, to the
  73. extent the Waiver is so judged Affirmer hereby grants to each affected
  74. person a royalty-free, non transferable, non sublicensable, non
  75. exclusive, irrevocable and unconditional license to exercise Affirmer's
  76. Copyright and Related Rights in the Work (i) in all territories
  77. worldwide, (ii) for the maximum duration provided by applicable law or
  78. treaty (including future time extensions), (iii) in any current or
  79. future medium and for any number of copies, and (iv) for any purpose
  80. whatsoever, including without limitation commercial, advertising or
  81. promotional purposes (the "License"). The License shall be deemed
  82. effective as of the date CC0 was applied by Affirmer to the Work. Should
  83. any part of the License for any reason be judged legally invalid or
  84. ineffective under applicable law, such partial invalidity or
  85. ineffectiveness shall not invalidate the remainder of the License, and
  86. in such case Affirmer hereby affirms that he or she will not (i)
  87. exercise any of his or her remaining Copyright and Related Rights in the
  88. Work or (ii) assert any associated claims and causes of action with
  89. respect to the Work, in either case contrary to Affirmer's express
  90. Statement of Purpose.
  91. 4. Limitations and Disclaimers.
  92. a. No trademark or patent rights held by Affirmer are waived, abandoned,
  93. surrendered, licensed or otherwise affected by this document.
  94. b. Affirmer offers the Work as-is and makes no representations or
  95. warranties of any kind concerning the Work, express, implied, statutory
  96. or otherwise, including without limitation warranties of title,
  97. merchantability, fitness for a particular purpose, non infringement, or
  98. the absence of latent or other defects, accuracy, or the present or
  99. absence of errors, whether or not discoverable, all to the greatest
  100. extent permissible under applicable law.
  101. c. Affirmer disclaims responsibility for clearing rights of other
  102. persons that may apply to the Work or any use thereof, including without
  103. limitation any person's Copyright and Related Rights in the Work.
  104. Further, Affirmer disclaims responsibility for obtaining any necessary
  105. consents, permissions or other rights required for any use of the Work.
  106. d. Affirmer understands and acknowledges that Creative Commons is not a
  107. party to this document and has no duty or obligation with respect to
  108. this CC0 or use of the Work.
