  8. Dedication. CC also makes the Commons deeds associated with its

  10. Mark available under the CC0 Public Domain Dedication. This allows
  11. anyone to reuse those texts for any purpose; however, CC reserves
  12. fully and unconditionally all trademark and branding rights
  13. associated with the licenses, the CC0 Public Domain Dedication,
  14. and the Commons deeds.

  23. THE USE OF THIS DOCUMENT OR THE INFORMATION OR WORKS PROVIDED

  25. Statement of Purpose
  26. The laws of most jurisdictions throughout the world automatically confer
  27. exclusive Copyright and Related Rights (defined below) upon the creator
  28. and subsequent owner(s) (each and all, an "owner") of an original work of
  29. authorship and/or a database (each, a "Work").
  30. Certain owners wish to permanently relinquish those rights to a Work for
  31. the purpose of contributing to a commons of creative, cultural and
  32. scientific works ("Commons") that the public can reliably and without fear
  33. of later claims of infringement build upon, modify, incorporate in other
  34. works, reuse and redistribute as freely as possible in any form whatsoever
  35. and for any purposes, including without limitation commercial purposes.
  36. These owners may contribute to the Commons to promote the ideal of a free
  37. culture and the further production of creative, cultural and scientific
  38. works, or to gain reputation or greater distribution for their Work in
  39. part through the use and efforts of others.
  40. For these and/or other purposes and motivations, and without any
  41. expectation of additional consideration or compensation, the person
  42. associating CC0 with a Work (the "Affirmer"), to the extent that he or she
  43. is an owner of Copyright and Related Rights in the Work, voluntarily
  44. elects to apply CC0 to the Work and publicly distribute the Work under its
  45. terms, with knowledge of his or her Copyright and Related Rights in the
  46. Work and the meaning and intended legal effect of CC0 on those rights.
  47. 1. Copyright and Related Rights. A Work made available under CC0 may be
  48. protected by copyright and related or neighboring rights ("Copyright and
  49. Related Rights"). Copyright and Related Rights include, but are not
  50. limited to, the following:
  51. i. the right to reproduce, adapt, distribute, perform, display,
  52. communicate, and translate a Work;
  53. ii. moral rights retained by the original author(s) and/or performer(s);
  54. iii. publicity and privacy rights pertaining to a person's image or
  55. likeness depicted in a Work;
  56. iv. rights protecting against unfair competition in regards to a Work,
  57. subject to the limitations in paragraph 4(a), below;
  58. v. rights protecting the extraction, dissemination, use and reuse of data
  59. in a Work;
  60. vi. database rights (such as those arising under Directive 96/9/EC of the
  61. European Parliament and of the Council of 11 March 1996 on the legal
  62. protection of databases, and under any national implementation
  63. thereof, including any amended or successor version of such
  64. directive); and
  65. vii. other similar, equivalent or corresponding rights throughout the
  66. world based on applicable law or treaty, and any national
  67. implementations thereof.
  68. 2. Waiver. To the greatest extent permitted by, but not in contravention
  69. of, applicable law, Affirmer hereby overtly, fully, permanently,
  70. irrevocably and unconditionally waives, abandons, and surrenders all of
  71. Affirmer's Copyright and Related Rights and associated claims and causes
  72. of action, whether now known or unknown (including existing as well as
  73. future claims and causes of action), in the Work (i) in all territories
  74. worldwide, (ii) for the maximum duration provided by applicable law or
  75. treaty (including future time extensions), (iii) in any current or future
  76. medium and for any number of copies, and (iv) for any purpose whatsoever,
  77. including without limitation commercial, advertising or promotional
  78. purposes (the "Waiver"). Affirmer makes the Waiver for the benefit of each
  79. member of the public at large and to the detriment of Affirmer's heirs and
  80. successors, fully intending that such Waiver shall not be subject to
  81. revocation, rescission, cancellation, termination, or any other legal or
  82. equitable action to disrupt the quiet enjoyment of the Work by the public
  83. as contemplated by Affirmer's express Statement of Purpose.
  84. 3. Public License Fallback. Should any part of the Waiver for any reason
  85. be judged legally invalid or ineffective under applicable law, then the
  86. Waiver shall be preserved to the maximum extent permitted taking into
  87. account Affirmer's express Statement of Purpose. In addition, to the
  88. extent the Waiver is so judged Affirmer hereby grants to each affected
  89. person a royalty-free, non transferable, non sublicensable, non exclusive,
  90. irrevocable and unconditional license to exercise Affirmer's Copyright and
  91. Related Rights in the Work (i) in all territories worldwide, (ii) for the
  92. maximum duration provided by applicable law or treaty (including future
  93. time extensions), (iii) in any current or future medium and for any number
  94. of copies, and (iv) for any purpose whatsoever, including without
  95. limitation commercial, advertising or promotional purposes (the
  96. "License"). The License shall be deemed effective as of the date CC0 was
  97. applied by Affirmer to the Work. Should any part of the License for any
  98. reason be judged legally invalid or ineffective under applicable law, such
  99. partial invalidity or ineffectiveness shall not invalidate the remainder
  100. of the License, and in such case Affirmer hereby affirms that he or she
  101. will not (i) exercise any of his or her remaining Copyright and Related
  102. Rights in the Work or (ii) assert any associated claims and causes of
  103. action with respect to the Work, in either case contrary to Affirmer's
  104. express Statement of Purpose.
  105. 4. Limitations and Disclaimers.
  106. a. No trademark or patent rights held by Affirmer are waived, abandoned,
  107. surrendered, licensed or otherwise affected by this document.
  108. b. Affirmer offers the Work as-is and makes no representations or
  109. warranties of any kind concerning the Work, express, implied,
  110. statutory or otherwise, including without limitation warranties of
  111. title, merchantability, fitness for a particular purpose, non
  112. infringement, or the absence of latent or other defects, accuracy, or
  113. the present or absence of errors, whether or not discoverable, all to
  114. the greatest extent permissible under applicable law.
  115. c. Affirmer disclaims responsibility for clearing rights of other persons
  116. that may apply to the Work or any use thereof, including without
  117. limitation any person's Copyright and Related Rights in the Work.
  118. Further, Affirmer disclaims responsibility for obtaining any necessary
  119. consents, permissions or other rights required for any use of the
  120. Work.
  121. d. Affirmer understands and acknowledges that Creative Commons is not a
  122. party to this document and has no duty or obligation with respect to
  123. this CC0 or use of the Work.
