  14. 1. DEFINITIONS
  15. a. "Act of War" means any action of one country against any group
  16. either with an intention to provoke a conflict or an action that
  17. occurs during a declared war or during armed conflict between
  18. military forces of any origin. This includes but is not limited
  19. to enforcing sanctions or sieges, supplying armed forces,
  20. or profiting from the manufacture of tools or weaponry used in
  21. military conflict.
  22. b. "Adaptation" means a work based upon the Work, or upon the
  23. Work and other pre-existing works, such as a translation,
  24. adaptation, derivative work, arrangement of music or other
  25. alterations of a literary or artistic work, or phonogram or
  26. performance and includes cinematographic adaptations or any
  27. other form in which the Work may be recast, transformed, or
  28. adapted including in any form recognizably derived from the
  29. original, except that a work that constitutes a Collection will
  30. not be considered an Adaptation for the purpose of this License.
  31. For the avoidance of doubt, where the Work is a musical work,
  32. performance or phonogram, the synchronization of the Work in
  33. timed-relation with a moving image ("synching") will be
  34. considered an Adaptation for the purpose of this License.
  35. c. "Bodily Harm" means any physical hurt or injury to a person that
  36. interferes with the health or comfort of the person and that is more
  37. more than merely transient or trifling in nature.
  38. d. "Collection" means a collection of literary or artistic
  39. works, such as encyclopedias and anthologies, or performances,
  40. phonograms or broadcasts, or other works or subject matter other
  41. than works listed in Section 1(i) below, which, by reason of the
  42. selection and arrangement of their contents, constitute
  43. intellectual creations, in which the Work is included in its
  44. entirety in unmodified form along with one or more other
  45. contributions, each constituting separate and independent works
  46. in themselves, which together are assembled into a collective
  47. whole. A work that constitutes a Collection will not be
  48. considered an Adaptation (as defined above) for the purposes of
  49. this License.
  50. e. "Distribute" means to make available to the public the
  51. original and copies of the Work or Adaptation, as appropriate,
  52. through sale, gift or any other transfer of possession or
  53. ownership.
  54. f. "Incarceration" means confinement in a jail, prison, or any
  55. other place where individuals of any kind are held against
  56. either their will or the will of their legal guardians.
  57. g. "Licensor" means the individual, individuals, entity or
  58. entities that offer(s) the Work under the terms of this License.
  59. h. "Original Author" means, in the case of a literary or
  60. artistic work, the individual, individuals, entity or entities
  61. who created the Work or if no individual or entity can be
  62. identified, the publisher; and in addition (i) in the case of a
  63. performance the actors, singers, musicians, dancers, and other
  64. persons who act, sing, deliver, declaim, play in, interpret or
  65. otherwise perform literary or artistic works or expressions of
  66. folklore; (ii) in the case of a phonogram the producer being the
  67. person or legal entity who first fixes the sounds of a
  68. performance or other sounds; and, (iii) in the case of
  69. broadcasts, the organization that transmits the broadcast.
  70. i. "Work" means the literary and/or artistic work offered under
  71. the terms of this License including without limitation any
  72. production in the literary, scientific and artistic domain,
  73. whatever may be the mode or form of its expression including
  74. digital form, such as a book, pamphlet and other writing; a
  75. lecture, address, sermon or other work of the same nature; a
  76. dramatic or dramatico-musical work; a choreographic work or
  77. entertainment in dumb show; a musical composition with or
  78. without words; a cinematographic work to which are assimilated
  79. works expressed by a process analogous to cinematography; a work
  80. of drawing, painting, architecture, sculpture, engraving or
  81. lithography; a photographic work to which are assimilated works
  82. expressed by a process analogous to photography; a work of
  83. applied art; an illustration, map, plan, sketch or
  84. three-dimensional work relative to geography, topography,
  85. architecture or science; a performance; a broadcast; a
  86. phonogram; a compilation of data to the extent it is protected
  87. as a copyrightable work; or a work performed by a variety or
  88. circus performer to the extent it is not otherwise considered a
  89. literary or artistic work.
  90. j. "You" means an individual or entity exercising rights under
  91. this License who has not previously violated the terms of this
  92. License with respect to the Work, or who has received express
  93. permission from the Licensor to exercise rights under this
  94. License despite a previous violation.
  95. k. "Publicly Perform" means to perform public recitations of the
  96. Work and to communicate to the public those public recitations,
  97. by any means or process, including by wire or wireless means or
  98. public digital performances; to make available to the public
  99. Works in such a way that members of the public may access these
  100. Works from a place and at a place individually chosen by them;
  101. to perform the Work to the public by any means or process and
  102. the communication to the public of the performances of the Work,
  103. including by public digital performance; to broadcast and
  104. rebroadcast the Work by any means including signs, sounds or
  105. images.
  106. l. "Reproduce" means to make copies of the Work by any means
  107. including without limitation by sound or visual recordings and
  108. the right of fixation and reproducing fixations of the Work,
  109. including storage of a protected performance or phonogram in
  110. digital form or other electronic medium.
  111. m. "Software" means any digital Work which, through use of a
  112. third-party piece of Software or through the direct usage of
  113. itself on a computer system, the memory of the computer is
  114. modified dynamically or semi-dynamically. "Software",
  115. secondly, processes or interprets information.
  116. n. "Source Code" means the human-readable form of Software
  117. through which the Original Author and/or Distributor originally
  118. created, derived, and/or modified it.
  119. o. "Surveilling" means the use of the Work to either
  120. overtly or covertly observe and record persons and or their
  121. activities.
  122. p. "Web Service" means the use of a piece of Software to
  123. interpret or modify information that is subsequently and directly
  124. served to users over the Internet.
  125. q. "Discriminate" means the use of a work to differentiate between
  126. humans in a such a way which prioritizes some above others on the
  127. basis of percieved membership within certain groups.
  128. r. "Hate Speech" means communication or any form
  129. of expression which is solely for the purpose of expressing hatred
  130. for some group or advocating a form of Discrimination
  131. (to Discriminate per definition in (q)) between humans.
  132. 2. FAIR DEALING RIGHTS
  133. Nothing in this License is intended to reduce, limit, or restrict any
  134. uses free from copyright or rights arising from limitations or
  135. exceptions that are provided for in connection with the copyright
  136. protection under copyright law or other applicable laws.
  137. 3. LICENSE GRANT
  138. Subject to the terms and conditions of this License, Licensor hereby
  139. grants You a worldwide, royalty-free, non-exclusive, perpetual (for the
  140. duration of the applicable copyright) license to exercise the rights in
  141. the Work as stated below:
  142. a. to Reproduce the Work, to incorporate the Work into one or
  143. more Collections, and to Reproduce the Work as incorporated in
  144. the Collections;
  145. b. to create and Reproduce Adaptations provided that any such
  146. Adaptation, including any translation in any medium, takes

  148. identify that changes were made to the original Work. For
  149. example, a translation could be marked "The original work was
  150. translated from English to Spanish," or a modification could

  152. c. to Distribute and Publicly Perform the Work including as

  154. d. to Distribute and Publicly Perform Adaptations. The above
  155. rights may be exercised in all media and formats whether now
  156. known or hereafter devised. The above rights include the right

  158. exercise the rights in other media and formats. Subject to
  159. Section 8(g), all rights not expressly granted by Licensor are
  160. hereby reserved, including but not limited to the rights set
  161. forth in Section 4(i).
  162. 4. RESTRICTIONS
  163. The license granted in Section 3 above is expressly made subject to and
  164. limited by the following restrictions:
  165. a. You may Distribute or Publicly Perform the Work only under
  166. the terms of this License. You must include a copy of, or the
  167. Uniform Resource Identifier (URI) for, this License with every
  168. copy of the Work You Distribute or Publicly Perform. You may not
  169. offer or impose any terms on the Work that restrict the terms of
  170. this License or the ability of the recipient of the Work to
  171. exercise the rights granted to that recipient under the terms of
  172. the License. You may not sublicense the Work. You must keep
  173. intact all notices that refer to this License and to the

  194. digital file-sharing or otherwise shall not be considered to be

  196. monetary compensation, provided there is no payment of any
  197. monetary compensation in connection with the exchange of
  198. copyrighted works.
  199. c. If the Work meets the definition of Software, You may exercise
  200. the rights granted in Section 3 only if You provide a copy of the
  201. corresponding Source Code from which the Work was derived in digital
  202. form, or You provide a URI for the corresponding Source Code of
  203. the Work, to any recipients upon request.
  204. d. If the Work is used as or for a Web Service, You may exercise
  205. the rights granted in Section 3 only if You provide a copy of the
  206. corresponding Source Code from which the Work was derived in digital
  207. form, or You provide a URI for the corresponding Source Code to the
  208. Work, to any recipients of the data served or modified by the Web
  209. Service.
  210. e. You may exercise the rights granted in Section 3 for
  211. commercial purposes only if you satisfy any of the following:
  212. i. You are a worker-owned business or worker-owned
  213. collective; and
  214. ii. after tax, all financial gain, surplus, profits and
  215. benefits produced by the business or collective are
  216. distributed among the worker-owners unless a set amount
  217. is to be allocated towards community projects as decided
  218. by a previously-established consensus agreement between the
  219. worker-owners where all worker-owners agreed
  220. iii. You are not using such rights on behalf of a business
  221. other than those specified in 4(e.i) and elaborated upon in
  222. 4(e.ii), nor are using such rights as a proxy on behalf of a
  223. business with the intent to circumvent the aforementioned
  224. restrictions on such a business.
  225. f. Any use by a business that is privately owned and managed,
  226. and that seeks to generate profit from the labor of employees
  227. paid by salary or other wages, is not permitted under this
  228. license.
  229. g. You may exercise the rights granted in Section 3 for
  230. any purposes only if:
  231. i. You do not use the Work for the purpose of inflicting
  232. Bodily Harm on human beings (subject to criminal
  233. prosecution or otherwise) outside of providing medical aid.
  234. ii.You do not use the Work for the purpose of Surveilling
  235. or tracking individuals for financial gain.
  236. iii. You do not use the Work in an Act of War.
  237. iv. You do not use the Work for the purpose of supporting
  238. or profiting from an Act of War.
  239. v. You do not use the Work for the purpose of Incarceration.
  240. vi. You do not use the Work for the purpose of extracting
  241. oil, gas, or coal.
  242. vii. You do not use the Work for the purpose of
  243. expediting, coordinating, or facilitating paid work
  244. undertaken by individuals under the age of 12 years.
  245. viii. You do not use the Work to either Discriminate or
  246. spread Hate Speech on the basis of sex, sexual orientation,
  247. gender identity, race, age, disability, color, national origin,
  248. religion, or lower economic status.
  249. h. If You Distribute, or Publicly Perform the Work or any
  250. Adaptations or Collections, You must, unless a request has been
  251. made pursuant to Section 4(a), keep intact all copyright notices
  252. for the Work and provide, reasonable to the medium or means You
  253. are utilizing: (i) the name of the Original Author (or
  254. pseudonym, if applicable) if supplied, and/or if the Original
  255. Author and/or Licensor designate another party or parties (e.g.,
  256. a sponsor institute, publishing entity, journal) for attribution
  257. ("Attribution Parties") in Licensor!s copyright notice, terms of
  258. service or by other reasonable means, the name of such party or
  259. parties; (ii) the title of the Work if supplied; (iii) to the
  260. extent reasonably practicable, the URI, if any, that Licensor
  261. specifies to be associated with the Work, unless such URI does
  262. not refer to the copyright notice or licensing information for
  263. the Work; and, (iv) consistent with Section 3(b), in the case of
  264. an Adaptation, a credit identifying the use of the Work in the

  283. i. Non-waivable Compulsory License Schemes. In those

  286. cannot be waived, the Licensor reserves the exclusive
  287. right to collect such royalties for any exercise by You of
  288. the rights granted under this License;
  289. ii. Waivable Compulsory License Schemes. In those
  290. jurisdictions in which the right to collect royalties
  291. through any statutory or compulsory licensing scheme can
  292. be waived, the Licensor reserves the exclusive right to
  293. collect such royalties for any exercise by You of the

  336. 6. LIMITATION ON LIABILITY
  337. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL
  338. LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL,
  339. INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF

  342. 7. TERMINATION
  343. a. This License and the rights granted hereunder will terminate
  344. automatically upon any breach by You of the terms of this
  345. License. Individuals or entities who have received Adaptations
  346. or Collections from You under this License, however, will not
  347. have their licenses terminated provided such individuals or
  348. entities remain in full compliance with those licenses. Sections
  349. 1, 2, 5, 6, 7, and 8 will survive any termination of this
  350. License.
  351. b. Subject to the above terms and conditions, the license
  352. granted here is perpetual (for the duration of the applicable
  353. copyright in the Work). Notwithstanding the above, Licensor
  354. reserves the right to release the Work under different license
  355. terms or to stop distributing the Work at any time; provided,
  356. however that any such election will not serve to withdraw this
  357. License (or any other license that has been, or is required to
  358. be, granted under the terms of this License), and this License
  359. will continue in full force and effect unless terminated as

  361. 8. REVISED LICENSE VERSIONS

  377. a. Each time You Distribute or Publicly Perform the Work or a
