- To Whom It May Concern
- [in any case, please forward to Mr. xxxx of your support team.]
- My name is zzzz. I am one of the major copyright holders of
- the code for the U-Boot boot loader project. U-Boot is licensed under
- the GNU Public License Version 2 (GPL-2.0). I would like to point out
- that this is the only available license for this code, there are not
- other options.
- It has been brought to my attention that UBIQUITI NETWORKS apparently
- violates the GPL license terms consciously and deliberately:
- In the last few weeks, Mr. Riley Baird (on cc:) inquired your support
- team and asked for the complete source code of the U-Boot boot loader
- in the version used in your Airmax routers.
- He did not succeed.
- Mr. xxxx of your support team wrote on Jun 19 15:09 (UTC-7):
- | Hi Riley,
- |
- | I'm really sorry, we don't share u-boot source. We used to in the past
- | but not any more. This decision was taken keeping the security of the
- | users in mind. I hope you understand.
- I think such a decision must be a misunderstanding on your side about
- the obligations resulting from distributing with your products soft-
- ware that is covered by the GPL. In case of doubt, you may find it
- useful to study [1] and [2]. Please feel free to contact me if you
- feel I could help you setting up a GPL compliant distribution method
- for the GPL software used in your systems.
- In any case, in my role as major copyright holder, I would like to
- remind you that any decision like "we don't share u-boot source"
- constitutes a serious GPL license violation; if you do not accept the
- GPL license terms that means that you have no permissions to use and
- distribute that software at all. If taken to the limit, that could
- mean that a prohibition of sale could be obtained for all products
- which are based on such software. I am sure that both of us would
- like to avoid the efforts and pain of any such escalations.
- I would like to ask you to:
- 1) provide, without further delay, the full source code of U-Boot as
- requested previously to Mr. Riley Baird;
- 2) establish within your company procedures to make sure not to
- violate license terms;
- 3) educate your support team and whoever else might be affected about
- this corrective measures to your policy when dealing with GPL
- software.
- 4) inform me about the steps you have taken, and, if not completed at
- the time you write me, about the schedule for their completion.
- Providing the full source code of U-Boot to Mr. Riley Baird is the
- most urgent and easiest to perform step, so I think you should be able
- to send me a confirmation for that within the next 10 calendar days,
- i. e. not later than July 11, 2014.
- Thank you very much in advance for your cooperation.
