  1. GPL Compliance Case Studies and Legal Ethics in Free Software Licensing
  2. This one-day course presents the details of five different GPL compliance
  3. cases handled by FSF's GPL Compliance Laboratory. Each case offers unique
  4. insights into problems that can arise when the terms of GPL are not
  5. properly followed, and how diplomatic negotiation between the violator and
  6. the copyright holder can yield positive results for both parties.
  7. This course also includes a unit on the ethical considerations for
  8. attorneys who want to represent clients that make use of or sell Free
  9. Software products.
  10. Prerequisites:
  11. Attendees should have successfully completely the course, a "Detailed
  12. Study and Analysis of GPL and LGPL", as the material from that course
  13. forms the building blocks for this material.
  14. Audience:
  15. The course is of most interest to lawyers who have clients or
  16. employers that deal with Free Software on a regular basis. However,
  17. technical managers and executives whose businesses use or distribute
  18. Free Software will also find the course very helpful.
  19. The course will include the topics listed below, along with ample time for
  20. questions and discussions. Lunch is included, with a lunch speaker to be
  21. announced.
  22. GPL Compliance Case Studies:
  23. * Overview of FSF's GPL Compliance Lab (:20)
  24. We present a brief introduction to the work that FSF does to enforce
  25. the GPL and defend the freedoms granted by Free Software.
  26. * GPL Violation Case Study A (1:00)
  27. In this case study, we consider one of the most complex and
  28. longest-running violations that FSF has handled. Company A
  29. distributed a derivative work of the GNU Complier Collection (GCC)
  30. without complete corresponding source, and refused to distribute any
  31. source at all to anyone who was not their direct customer. We
  32. follow the slow movement toward compliance and explain how FSF deals
  33. with sometimes belligerent violators.
  34. * GPL Violation Case Study B (:20)
  35. In this case study, we consider a contrasting violation to Case A.
  36. Company B, who sold a complete GNU/Linux distribution, had worked
  37. hard to be in compliance, but we had nevertheless found an
  38. infraction in their compliance efforts. We explain how smoothly
  39. violations of this type can be resolved and the process that an
  40. otherwise friendly violator can expect.
  41. * GPL Violation Case Study C (:35)
  42. In this case study, we present a violation where an entire embedded
  43. GNU/Linux distribution was included in a consumer electronic device.
  44. We consider the problems faced regarding kernel modules for device
  45. drivers for government-regulated hardware, and cases where both an
  46. upstream provider and a downstream distributor are in violation on
  47. separate matters.
  48. * GPL Violation Case Study D (:25)
  49. In this case study, we consider how to handle the inevitable
  50. violations that can occur from a company that is generally committed
  51. to doing Free Software as a regular part of its business, but -- due
  52. to experimentation with new cutting edge business models, or because
  53. of mere oversights -- has occasional GPL violations or
  54. near-violations.
  55. * Good Practices for GPL Compliance (:10)
  56. After discussing the details of the various archetypes of GPL
  57. compliance efforts undertaken by FSF, we generalize what we have
  58. learned to advise on good practices to build a product from start to
  59. finish in compliance with GPL, and how to build internal policies to
  60. assure that your client or company is never faced with a violation
  61. report.
  62. Ethical Considerations for the Attorney Practicing Free Software
  63. This portion of the course will focus on ethical issues that may arise
  64. for attorneys counseling clients with respect to free software issues.
  65. Many of these topics have more general application, but specific
  66. discussion of the ways in which these issues may arise for free software
  67. clients will be presented.
  68. * Part I: Representing Free Software Clients (1:00)
  69. An attorney's ethical duties run to not just their clients, but to
  70. potential clients and the general public as well. Pro bono
  71. representation of free software clients not only conforms with the
  72. principles set forth by most Bar Associations, but also provides
  73. many other benefits to an attorney. Once a client is retained, the
  74. duty of loyalty attaches and conflicts, be they direct, indirect,
  75. or political, should be identified and handled.
  76. * Part II: Practicing Free Software (1:00)
  77. Differing ethical issues arise in the context of counseling a
  78. client who is a free software licensor as opposed to one who is a
  79. free software licensee. Further still, representing a client who
  80. is both licensor and licensee presents a combination of all of
  81. these issues. Compliance investigation and enforcement strategies
  82. must be implemented in accordance with both the duty of loyalty and
  83. the duty of honesty. Likewise, performing exposure abatement while
  84. also defending against charges of infringement may pose problems
  85. within the attorney-client relationship. The ethical considerations
  86. relevant to each of these situations will be presented and
  87. discussed.
  88. * Part III: More General Ethical Considerations Relevant to Free
  89. Software (1:00)
  90. Free software counseling is but one specialty within the realm of
  91. intellectual property counseling in general. A review of various
  92. topics of more general application, but with special relevance to
  93. free software counseling, will be given along with a discussion of
  94. the reasons why and ways in which such issues arise when
  95. representing free software clients. Patent prosecution and
  96. governing rules considerations are two such topics.
